Terms of Use Forum FAST

In these Terms of Use, terms written with an initial capital letter have the following meanings (both singular and plural):

Account the free membership pursuant to which the User is granted access to the interactive parts of the Website, such as the Forum.
Content All data and files of FAST or the Users accessible through the Website such as, for example, posts, reviews, moderations, advertisements, illustrations, video and sound clips and photographs.

Forum FAST’s discussion platform on which a User can post messages and respond to already existing messages.

Login Information The login name and password associated with the Account.
Malware a virus or any other software routine that is intended or designed to allow access to, or use of, a computer system by an unauthorized person, or to render a computer system unusable, damage or erase it or interfere with or impair its normal use.
Policies the policies, conditions and other documents accessible through the Website that contain binding rules for the use of (certain parts of) the Website, including the Forum.
Sanction A warning, (temporary) disqualification or other sanction following a User’s conduct.
Website The set of web pages, software, databases, services and Content posted by FAST linked to the domain name www.fast.nl and to its subdomains and related domains (such as, for example, www.forum.fast.nl) and all services accessible through this website such as, for example, the Forum.

General information and definitions

  • 1.1 Expertise center FAST (Center for Future Affordable and Sustainable Therapy development) focuses on developing, producing and making new therapies available to patients faster, smarter, better and cheaper. In this context, FAST offers through its website (the Website) a forum (the Forum) where Users with an account can share knowledge with each other. The Forum is accessible to any visitor to the Website. On the Forum, anyone with an Account can contribute by posting a message, images and other information.

  • 1.2 Access to this Website and related services such as the Forum is granted on the condition that the terms contained in these Terms of Use are accepted by the visitor.

  • 1.3 We therefore recommend that you read these Terms of Use carefully so that you are aware of your rights and obligations when using the Website.

  • 1.4 By creating an Account through FAST’s Forum, you enter into an agreement (Agreement) with FAST and agree to these Terms of Use.

Applicability

  • 2.1 These Terms of Use apply to any use of the Website and related services such as the Forum and any new versions thereof.

Register for an Account

  • 3.1 A User may register free of charge by creating an Account through the Website and following the instructions provided for that purpose.

  • 3.2 If a User is under 18 years of age, the consent of a parent or legal representative is required to create an Account. By creating an Account, the User warrants that they are 18 years of age or older or have permission from a parent or legal representative.

  • 3.3 FAST reserves the right to suspend an Account again after registration and/or (temporarily) block access to (certain parts of) the Website at any time if FAST deems it necessary, without notifying the User in advance.

  • 3.4 The Login Information is strictly personal and may not be made available to third parties. The User is responsible for the use made of his Login Information, even if this is done without his knowledge.

  • 3.5 The User shall notify FAST immediately if he suspects that his Login Information is known to a third party or that irregularities otherwise occur

  • 3.6 A User is not permitted to create or manage more than one (1) Account. A User is further not permitted to create or manage (again) an Account after FAST has cancelled a User’s Account after registration.

Instructions for use

  • 4.1 The User shall refrain from unauthorized use of the Website and shall act and behave in accordance with what may be expected by FAST of a prudent User.

  • 4.2 In particular, the User shall:

    • a. abide by FAST’s Terms of Use;
    • b. Adhere to the regulations and guidelines published on the FAST website;
    • c. Not perform acts or post Content that violate laws or regulations, morals or public order;
    • d. comply with all rules and instructions displayed on the Website or addressed to him, including instructions from FAST;
    • e. not encourage or assist anyone who violates these Terms of Use;
    • f. not infringe or otherwise violate intellectual property rights of FAST or third parties;
    • g. Not impersonate anyone else through the Website (especially through the Forum);
    • h. Not take any action or post Content that causes a nuisance to other Users or visitors to the Website;
    • i. Not distribute spam or other unsolicited messages to other Users or visitors to the Website and/or the Forum via, for example, instant messaging (such as Discord, Slack, WhatsApp, etc.), direct messaging (the Website’s contact form or via FAST’s Forum) and e-mail;
    • j. not buy, sell or otherwise trade user names or other unique identifiers on the Forum;
    • k. not post on the Forum any information that could be considered advertising (e.g. for your own services/activities);
    • l. not automate access to the Website, or monitor the Website, such as with a web crawler, browser plug-in or add-on, or other computer program that is not a web browser. Users may crawl the Website to index it for a public search engine, if they operate one;
    • m. not modify, delete or disable any Content of FAST or other Users;
    • n. not falsely suggest that he is affiliated with or endorsed by FAST;
    • o. not spread Malware;
    • p. not use robots, spiders, website search applications or other means of searching or indexing (parts of) the Website and User Content;
    • q. not burden the Website’s infrastructure with an unreasonable amount of requests, or requests intended to place an unreasonable burden on the information systems underlying the Website;
    • r. not disable, circumvent or circumvent FAST’s security or access restrictions;
    • s. not use adblockers or otherwise block advertising.
  • 4.3 The User is responsible for the content of all Content posted to the Website through their Account. FAST advises the User not to post personal information on the Website such as address details, telephone numbers or financial information, nor confidential information and/or information protected by any intellectual property right. In principle, FAST is not obliged to verify and/or remove this personal information.

  • 4.4 User acknowledges that FAST has no obligation to actively manage, edit, review or monitor User Content prior to posting on the Website. FAST does not guarantee the quality, accuracy or legality of Users’ Content.

  • 4.5 If FAST determines that certain User Content does not comply with these Terms of Use and/or applicable laws and regulations, FAST may investigate and, where appropriate, modify or remove the content or design of such Content in its sole discretion. FAST may also change the content or design of the Content to ensure the readability or overall quality of the Website. FAST shall not be liable or responsible for the performance or non-performance of the activities referred to in this paragraph.

  • 4.6 The User may not (at the sole discretion of FAST) post any Content on the Website:
    i. which is (sexually) intimidating, offensive, discriminatory, of a pornographic nature or which should otherwise be considered controversial by general standards;
    ii. in which pyramid schemes or chain letters are promoted;
    iii. that violates the privacy or privacy of other Users or visitors to the Website;
    iv. which includes a photograph or image of another person without their permission;
    v. in which pirated software is offered or solicited;
    vi. which is focused on recruiting;
    vii. For advertising or marketing purposes.

  • 4.7 If the User believes that another User or a visitor to the Website is acting in violation of this Article 4, the User may notify FAST.

  • 4.8 If, in the opinion of FAST, the User fails, in whole or in part, to comply with the provisions of Article 4.6 subsection vii, the User shall be liable to FAST for an immediately payable penalty of EUR 1,500 (fifteen hundred euros) for each instance of non-compliance, without the need for a notice or any other prior statement. This penalty will accrue to FAST without prejudice to all other rights or claims of FAST, including the right to compliance and the right to damages in addition to the penalty.

Direct Messages

  • 5.1 In addition to communication in publicly visible messages and comments on the Forum, it may be possible to communicate directly with other Users through Direct Messages (DM). This system is also referred to as ‘chat’ or ‘message’.

  • 5.2 Users should note that it is at all times possible that (the administrators of) FAST decide(s) to view these messages if there is suspicion of a criminal offense, violation of applicable laws and regulations, abuse of the system, harassment of other Users, complaints from other Users, or there are, in our opinion, other pressing reasons to view them.

  • 5.3 No rights can be derived from the chat. FAST is entitled to disable, limit or condition its use at any time. The chat system should be seen as additional.

Sanctions

  • 6.1 FAST may impose a Sanction on the User if he violates the Terms of Use. The User is entitled to mediation as further described in these Terms of Use. However, FAST may unilaterally decide not to apply the right to mediation, for example if the User is found to be acting in the exercise of a profession or business or otherwise has commercial intentions. More information about the sanction guidelines and the mediation and appeal options is included in the Policies.

  • 6.2 Without prejudice to any other right of FAST under the law or the Terms of Use, if the User violates Article 4 of these Terms of Use or any other terms and conditions and/or guidelines, FAST shall be entitled to terminate with immediate effect and without notice:

    • a. issuing a warning to the User;
    • b. modify or delete Content posted by the User;
    • c. deny the User access to the Website (temporarily or otherwise); and
    • d. cancel the User’s Account.
  • 6.3 FAST shall not be liable for any costs or damages incurred by the User in connection with any Sanction imposed.

Rights and obligations of FAST

  • 7.1 FAST will use its best efforts to make the Website available to the User. FAST does not guarantee that the Website will be available at all times, uninterrupted or complete.

  • 7.2 FAST reserves the right to:
    a. block the Website unannounced or take it out of service for the purpose of maintenance, modification or improvement thereof;
    b. modify, expand, delete or otherwise change portions of the Website unannounced.

  • 7.3 FAST does not warrant that the Website is free of errors, defects or Malware or that the Website is current, complete or accurate.

  • 7.4 FAST is not responsible for acts or omissions of other Users. The Content of Users or other third parties reflects solely the personal opinions of such Users or third parties, and FAST is not responsible for its content.

  • 7.5 If certain hyperlinks or inserted images on the Website lead to external websites operated by third parties, FAST is not responsible for the content and operation of these external websites, nor for the quality of any software, products or services offered thereon and assumes no liability therefor. FAST’s privacy statement does not apply to personal data collected through these external websites.

License and intellectual property

  • 8.1 Subject to the provisions of these Terms of Use, in principle, the User retains the copyright and other intellectual property rights to the Content posted by him.

  • 8.2 All intellectual property rights, including but not limited to copyright and database rights, in the Website and the Content posted by FAST are owned exclusively by FAST or its licensors.

  • 8.3 The User may consult the Content included on the Website and make copies thereof exclusively for his own personal use, for example by printing or storing it. Any other use of the Website or the Content, for example copying, reproducing, distributing or otherwise disclosing all or part of the Website is not permitted without the express written consent of FAST and/or the relevant User.

  • 8.4 By posting Content on the Website:
    a. the User irrevocably authorizes FAST to publish, adapt and commercially exploit such Content through the Website without compensation;
    b. the User grants permission to other Users and visitors to the Website to access and make copies of such Content for their own use;
    c. User consents to FAST for the disclosure of his portrait, to the extent it appears in this Content; and
    d. the User waives, to the extent legally possible, the personality rights vested in the Content.

  • 8.5 The User guarantees that he is authorized to grant the foregoing consents and that he has obtained any consents from third parties necessary for publication of this information. The User indemnifies FAST and the other third parties working for it for all damages and costs related to claims by third parties that the use or exploitation of the Content posted by the User infringes on (intellectual) property rights of third parties or is otherwise unlawful towards third parties.

Privacy

  • 9.1 FAST’s privacy statement applies to the processing of personal data through FAST’s Website and is an integral part of these Terms of Use. Click here to access the privacy statement.

  • 9.2 The User warrants that he acts in full compliance with all applicable laws and regulations regarding the protection of personal data and unsolicited communications. In particular, the User warrants that he has obtained the necessary consents from third parties to publish personal data of third parties on the Website.

  • 9.3 Except to the extent expressly permitted by these Terms of Use, the User may not process or otherwise use personal data of other Users. In particular, the User is not permitted to (i) use such personal data of third parties to transmit unsolicited communications and (ii) collect such personal data, whether methodically or systematically ordered or otherwise.

Delete Account

  • 10.1 If you would like to delete your account, please send an email to: info@fast.nl. Clearly state the request to delete your account and send your email from the email address associated with the account to be deleted. Also include the words “Delete FAST Forum account” in the subject of your email.

  • 10.2 Content posted by the User cannot be deleted upon termination of the Account. FAST will anonymize the personal data associated with the Account so that the Content is no longer traceable to the User.

  • 10.3 FAST shall not be liable for any costs or damages incurred by the User in connection with the cancellation of an Account for any reason.

Liability

  • 11.1 FAST makes no warranty whatsoever as to the correctness or accuracy of the data, information, software or other components appearing on the Website, or as to their suitability for any purpose, situation or application. No reliance may be placed, for any reason, on the data, information, software and other uses or processing contained in this Website.

  • 11.2 FAST shall not be liable for any direct or indirect damages or costs of the User or third parties, on any grounds whatsoever, resulting from the use of (parts of) the Website, including damages resulting from the inaccuracy or incompleteness of the Content or resulting from Malware, unless the damages in question were caused by intent or deliberate recklessness on the part of FAST’s management.

  • 11.3 The User who acts in violation of his obligations arising from these Terms of Use is liable for all resulting damages to FAST.

  • 11.4 The User indemnifies FAST and the other third parties working for it against all third party claims for all damages and costs in any way caused by the use by the User of the Website and/or the Forum and the Content posted thereon, or by the User’s failure to fulfill his obligations under these Terms of Use.

Final Provisions

  • 12.1 When using the search function on FAST’s Website, search results are generated based on relevance, date or popularity, depending on the user’s choice. Relevance is measured by the number of views.

  • 12.2 The User is not entitled to transfer the rights and obligations from his Account and these Terms of Use to a third party without FAST’s prior written consent. FAST may transfer rights and obligations from the Account and these Terms of Use to third parties and will notify the User accordingly.

  • 12.3 If one or more provisions of these Terms of Use are void or voidable, this shall not affect the validity of the remaining provisions. In case of nullity of a provision of these Terms of Use, the parties shall be bound by a provision of as much as possible corresponding purport, which is not subject to nullity.

  • 12.4 The Hague District Court has exclusive jurisdiction over any dispute arising from or related to the Account or these Terms of Use.

  • 12.5 These Terms of Use, all agreements, subscriptions and (legal) acts between FAST and the User are exclusively governed by Dutch law.

Content moderation

FAST’s moderation policy applies to the moderation of Content performed by FAST on the Website and is attached as Appendix I to these Terms of Use.

APPENDIX I Moderation Policy FAST Forum.

We believe it is important that our Forum is and remains free of information that is unlawful or violates our terms and conditions. Therefore, we conduct content moderation. In this policy, we explain how content posted by Users on FAST’s Forum is moderated. We explain what action we may take and why, what you can do about it if you disagree with it as a poster of that information, and how to make a report if you suspect illegal content. In applying this policy, FAST always acts in a careful, objective and proportionate manner with due consideration for the rights and interests of our Users.

What requirements must content of posted messages meet?

FAST makes every effort to prevent illegal or unlawful information. Information is illegal or unlawful if it violates the law or any other terms of FAST.

How does FAST check the information that Users post?

While FAST has no general obligation to monitor the information it transmits/stores or to actively investigate illegal activity on our Forum, we are free to voluntarily investigate or take other measures to counter illegal/unlawful content on our Forum. We therefore proactively monitor our Forum for posts that do not comply with the law or our terms and conditions.

In addition, individuals may make a report to FAST when they suspect that certain content is unlawful or in violation of applicable terms and conditions. If an individual reports information on FAST’s Forum as unlawful or in violation of applicable terms, we review that information and evaluate it based on the substantiation of the report, the applicable terms, and the law. We do not pre-verify the information that Users post and only use human verification.

Measures

If, after a review, we determine that the information is not unlawful or does not violate applicable terms and conditions, we will leave it up and take no action.

If, after a review, we determine that the posted information is (potentially) unlawful or violates our terms and conditions, we may take action.

We may also receive an order from a judicial or administrative authority to take action against illegal content or to provide specific information about one or more specific User(s). We will notify the User who posted the information as soon as possible, but no later than the time at which the order is acted upon (unless different from the time specified in the order), of the order received and the action taken thereon.

We can take the following measures:

1. Information may be temporarily shielded/deleted

This occurs, for example, if further investigation into the legitimacy of the information is necessary. We may request additional information from the User who posted the information or the person who reported the information. Until we receive a response, we may decide to temporarily shield/delete the information. We will do this sooner if it is likely that the information is unlawful or in violation of our terms and conditions. Depending on the additional information we receive, we will either reinstate the information or keep it shielded/deleted.

2. The User may be requested to modify the content

This happens, for example, if only a part of the post can be considered illegal/in violation of our terms. In that case, we will contact the User who posted the information and explain in what way the post should be modified so that it is no longer considered unlawful/in violation of our terms. If the User refuses to modify the post, we may take additional action.

3. The message or certain information from the message can be deleted

This happens, for example, if it is determined that the post (or certain information in the post) can be considered unlawful/in violation of our terms and conditions and modification of the content is not sufficient/possible in our opinion.

4. The User’s account may be (temporarily) suspended (for example, for repeatedly posting illegal information or repeatedly making unfounded reports )

This occurs, for example, if the same User posts illegal information multiple times, or information that violates FAST’s applicable terms and conditions, or if the same User submits obvious unfounded reports or complaints to FAST multiple times. The User will always receive a warning prior to a suspension. A suspension lasts a maximum of twelve months. The duration of the suspension depends, among other things, on the severity of the unlawful information. For example, indecent language will result in a shorter suspension than discriminatory or hate speech. The amount of unlawful information posted may also affect (the duration of) any suspension.

5. The User’s ability to file reports and/or complaints may be (temporarily) suspended

This happens, for example, if a User submits multiple blatantly unfounded reports or complaints to FAST. FAST may - after issuing a warning - not handle the reports and complaints of this User for a period of up to twelve months. The period of this suspension depends, among other things, on the severity and intensity of the abuse of the reporting and complaint facilities. The higher the number of unfounded reports or complaints, the earlier/longer a suspension may be instituted.

We inform both the person who posted the information and the person making the report (to the extent we have his/her contact information) of our decision to leave the information in place or remove it. FAST reserves the right to remove the information or otherwise limit its visibility at any time.

Filing a complaint or making a report

Do you suspect that certain information on our Forum is illegal/in violation of our terms and conditions, or do you disagree with a decision to delete a post, leave it up, or a suspension decision for abuse? Then you can report it to FAST or file a complaint up to six months after the decision. If we agree with the complaint, we will reverse the decision. If we disagree with you, we will uphold the decision. If you want to report illegal content or file a complaint, you can follow the following roadmap:

  1. Send your report/complaint to FAST by emailing info@fast.nl;

  2. As the subject of the email, enter “DSA notification of illegal content” if it is suspected illegal content, and “DSA complaint” if it is a complaint;

  3. In the case of a report of suspected unlawful information: in your email, state your reasons why you believe the content is unlawful. Include as much relevant information as possible (such as the type of content, if possible the name of the provider of the content, the date/time the content was provided, etc.).

  4. In the case of a complaint: state in your e-mail your reasons for disagreeing with our decision. Include as much relevant information as possible;

  5. Indicate the country in which you think the content violates the law;

  6. If possible, provide a specific law or other legal basis for your report;

  7. Include your contact information;

  8. Send your email.

After receiving your report/complaint, we will review it and take action if necessary. We will notify you via email (if you have provided your contact information) of the outcome of our review.

Transparency and reporting

We think it’s important to keep you well informed about how we conduct content moderation. That’s why we publish a report about this on our website once a year. We also always inform you of important changes to this procedure.
